Terms of Service

1. Acceptance of Terms

By accessing or using the Operator platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

The Service is intended for business users and founders operating commercial ventures.

2. Description of the Service

The Service provides an autonomous execution infrastructure designed to:

• Analyze a company URL or product input • Generate structured market hypotheses • Establish an Operating Contract • Execute automated go-to-market cycles • Adapt strategy based on observed signals • Produce governance and performance reports

The Service operates within user-defined constraints ("Operating Contract"), including but not limited to budget caps, risk tolerance, compliance requirements, and market boundaries.

The Service does not guarantee revenue, profitability, fundraising success, or business viability.

3. Autonomous Execution Authority

By activating an Operator subscription, you authorize the Service to:

• Execute automated marketing, distribution, and positioning actions • Adjust strategy within the declared Operating Contract • Allocate capital within defined budget caps • Suppress or activate channels based on system evaluation • Delay monetization actions pending proof thresholds

The Service does not require per-action user approval unless explicitly stated.

You remain responsible for:

• The legality of your business • Compliance with applicable regulations • Accuracy of information provided • Oversight of business operations

4. Operating Contract

You define the boundaries within which the Operator acts. These may include:

• Monthly budget cap • Risk profile • Allowed markets • Compliance mode • Brand constraints

The Service will not exceed declared limits but may operate autonomously within them.

You may modify or pause your Operating Contract at any time. Changes may affect performance and results.

5. No Guarantee of Results

The Service provides automation and structured execution. It does not guarantee:

• Customer acquisition • Revenue generation • Market acceptance • Investment or funding outcomes • Specific growth rates

Past performance, projections, and probability indicators are informational and not guarantees.

6. User Responsibilities

You agree that:

• You own or have rights to the URL and content submitted. • Your use of the Service complies with applicable laws. • You will not use the Service for unlawful, fraudulent, harmful, or deceptive activities. • You will not attempt to reverse engineer, copy, or replicate core system logic. • You are solely responsible for decisions made outside the Service.

7. Subscriptions & Billing

All payments are processed via Stripe. By using the Service, you authorize us (or our payment processor) to charge your selected payment method.

Platform Subscription

• The subscription is billed immediately upon signup at $49/month (or $470/year). There is no free trial. • Subscriptions renew automatically until cancelled. You may cancel at any time, and execution cycles cease upon cancellation.

Prepaid Wallet

• Operator's usage-based operational costs are deducted in real time from a prepaid wallet, which you fund via Stripe. • Operator pauses when the wallet balance is insufficient to continue. Wallet balances are non-refundable except at our discretion.

We may modify pricing with reasonable notice.

8. Free Access & Preview

Free access may include:

• URL ingestion • Extraction preview • High-level market classification

Full strategy details and execution cycles require an active subscription. We reserve the right to modify free features at any time.

9. Data & Analytics

We may process:

• Submitted URLs • Extracted site content • Performance metrics • Execution logs • Usage telemetry

We may aggregate anonymized, non-identifiable data to improve system performance and intelligence models. We do not claim ownership of your company or intellectual property.

10. Intellectual Property

All system logic, execution models, state machines, and automation frameworks are the property of LaunchSurface.

You may not:

• Copy • Resell • Repackage • Reverse engineer

any part of the Service without written permission.

11. Two-Sided Market & Third-Party Actions

If your venture involves marketplace dynamics (e.g., supply and demand participants), you acknowledge:

• The Service may automate outreach or engagement actions. • Third-party responses are outside our control. • We are not responsible for actions taken by third parties.

You are responsible for ensuring compliance with marketing, communications, and data regulations applicable to your jurisdiction.

12. Limitation of Liability

To the maximum extent permitted by law:

The Service is provided "AS IS" without warranties of any kind.

We are not liable for:

• Lost profits • Lost business opportunities • Business interruption • Data loss • Indirect or consequential damages

Our total liability shall not exceed the amount paid by you in the preceding 3 months.

13. Indemnification

You agree to indemnify and hold harmless LaunchSurface from any claims arising from:

• Your use of the Service • Your business operations • Violation of applicable laws • Misuse of automated execution

14. Suspension & Termination

We may suspend or terminate access if:

• You violate these Terms • Payment fails • Your use poses legal or reputational risk

You may cancel at any time. Execution cycles cease upon cancellation.

15. Modifications

We may update these Terms from time to time. Continued use constitutes acceptance of updated Terms.

16. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.
